Terms and Conditions
Introduction
These Terms and Conditions govern the use of tidyaustralia.com and the cleaning services
provided by Tidy Australia (referred to as “Tidy”, “we” or “us”). By booking our services or
using our website, you agree to be bound by these Terms. If you do not agree with these
Terms, please do not use our services or the website. These Terms form the entire
agreement between you (“the Customer”) and Tidy Australia regarding our services.
Scope of Services
Tidy Australia provides residential and commercial cleaning services at the locations you
specify. The exact cleaning tasks (for example, vacuuming, mopping, dusting, bathroom
and kitchen cleaning, etc.) will be as agreed at the time of booking. We supply our own
cleaning materials and equipment unless otherwise arranged. To avoid disputes, we will
clearly outline any supplies or extra charges at booking (for instance, if special cleaning
products are required). We endeavor to perform all services diligently and professionally.
However, please note that cleaning outcomes can vary due to factors beyond our control.
As one cleaning services firm notes, results may depend on the premises’ condition and
other factors, and perfect results cannot be guaranteed.
Bookings and Payment
Bookings can be made online through tidyaustralia.com or by contacting us directly. At
booking, you must provide accurate personal and payment details. Payment for services is
due as follows: the quoted price must be paid in full before or immediately upon
completion of the servicemcocleaning.com.au. We accept payment via our online
payment gateway (credit/debit card or PayPal) or electronic funds transfer. If payment is not
received in accordance with these Terms, we reserve the right to treat the booking as
cancelled and to charge any applicable cancellation fee. Invoices not paid within 30 days
may incur debt-recovery costs; you agree to indemnify Tidy Australia for any legal or
collection costs we incur in recovering overdue payments
Cancellations and Refunds
• By You (Customer). You may cancel or reschedule a booked cleaning by giving us at
least 48 hours’ notice before the scheduled service time. If you cancel outside this
48-hour window, you will receive a full refund of any amounts paid. Cancellations
made with less than 48 hours’ notice will incur a cancellation fee (typically a call-out
or late-cancellation fee) to cover our lost time.
• By Us. We may need to cancel or reschedule due to unforeseen circumstances (e.g.
staff illness, extreme weather). In such cases, we will notify you as soon as possible
and either refund any payment or offer an alternative date.
• Refunds. If you are not satisfied with the service provided, please notify us within 5
days of completion so we can address the issue. We will endeavor to resolve any
problem promptly, for example by re-cleaning areas of concern at no extra charge. If
a major defect in the service is identified, Australian Consumer Law requires us to
re-perform the service or issue a refund. Any refunds will be processed to the
original payment method. Note that certain statutory guarantees (for example, that
services are provided with due care and skill) cannot be waived, so our liability in
case of a significant failure is limited to re-performance of the service or a refund of
the fee paid.
Customer Responsibilities
As the Customer, you must:
- • Prepare the Premises: Ensure a safe working environment for our cleaners (no
unsafe hazards) and provide unobstructed access to all areas to be cleaned. You
must supply necessary utilities during service (hot/cold running water, electricity,
and available waste bins). - • Secure Valuables: Remove or secure all fragile, delicate, or high-value items (such
as cash, jewellery, art, antiques, and items of sentimental value) before the service
begins. Tidy Australia will not be liable for damage to or loss of such items. - • Move Furniture: Move any heavy furniture or large items (e.g. large appliances) so
cleaners can clean underneath them, or notify us in advance if special
arrangements are needed. - • Provide Keys or Access: If you will not be present, provide keys, gate codes, or
lock-box details so our cleaners can enter the premises. If access is denied (e.g. no
keys or codes given), you may be charged a call-out fee or treated as a late
cancellation. - • Notify Hazards: Tell us of any hazards or special conditions at the premises (e.g.
wet floors, pet hazards, mold, grease spots, or electrical issues) that could affect
service or safety. - • Pets: Ensure pets are secured or removed from cleaning areas for safety. We are not
responsible for pet-related incidents during cleaning. - • Insurance: Maintain adequate home or business insurance for items on the
premises. While our cleaners carry public liability insurance you should insure
valuables independently.
Subcontractors
Tidy Australia may use qualified independent contractors (subcontractors) to perform
cleaning services. All subcontractors operate under the Tidy Australia name and are
required to meet our standards and hold their own public liability insurance. However, they
are not employees of Tidy Australia. You acknowledge that Tidy Australia’s role is to arrange
the service, and any subcontractor’s actions are on our behalf. To the extent permitted by
law, Tidy Australia is not liable for any acts or omissions of subcontractors that are beyond
our control.
Liability and Indemnity
Except as required by law (for example, under the Australian Consumer Law), Tidy
Australia’s liability is strictly limited. If the service fails to meet consumer guarantees (a
“major failure”), we will re-perform the service or refund the fee paidl. In all other cases,
our total liability will not exceed the amount you have paid for the service. We exclude all
liability for indirect, special or consequential losses (including loss of income, loss of use,
or inconvenience).
Specifically, Tidy Australia will not be liable for: broken or stained items that existed prior to
cleaning, or for damage caused by equipment or supplies provided by you; normal wear
and tear on surfaces; or damage from events outside our control (such as flooding, fire, or
other “force majeure”). We also exclude liability for loss or damage to “valuables” — e.g.
cash, jewelry, artwork, antiques, and sentimental items— so please secure such items
before our visit.
You agree to indemnify Tidy Australia and its subcontractors against any claims, losses or
costs arising from your breach of these Terms. For example, if you fail to provide payment
or otherwise violate these Terms, you will reimburse Tidy Australia for legal fees and other
expenses we incur in enforcing our rights.
Intellectual Property
All content on tidyaustralia.com (including text, graphics, logos, images and software) is
the property of Tidy Australia or its licensors. You may view and print pages from our
website only for your personal use in connection with our services. No material from the
site may be copied, reproduced, modified or distributed without our prior written
permission. The Tidy Australia name and logo are registered trademarks; unauthorized use
is prohibited.
Changes to Terms
Tidy Australia may update these Terms from time to time. Any changes will be posted on
tidyaustralia.com and will take effect immediately on posting. It is your responsibility to
review the Terms periodically. Your continued use of our services after changes are posted
constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of Western Australia. Any disputes arising under or in
connection with these Terms will be subject to the exclusive jurisdiction of the courts of
Western Australia.
